Acceptable Use Policy

1. Purpose and Scope

This Acceptable Use Policy ("AUP") governs the use of all services provided by NoobHost, operated by Noobenheim ("Company", "we", "us"). This AUP is incorporated into and forms part of our Terms of Service.

All users, including authorized third parties operating on your behalf, must comply with this policy. You are responsible for ensuring that all users of your account, services, and hosted applications comply with this AUP. Violations may result in immediate suspension or termination of your account without notice or refund, at our sole discretion.

2. Prohibited Content

You may not host, store, distribute, transmit, or link to content that:

  • Is illegal under any applicable local, state, national, or international law
  • Infringes on intellectual property rights, including pirated software, media, games, or copyrighted material
  • Contains malware, viruses, trojans, rootkits, worms, or other malicious or destructive code
  • Promotes violence, terrorism, extremism, or hate speech targeting any group
  • Contains child sexual abuse material (CSAM) - zero tolerance; reported to NCMEC and law enforcement immediately
  • Facilitates phishing, identity theft, scams, or financial fraud of any kind
  • Contains personal data obtained without consent, including but not limited to doxxing or data dumps
  • Hosts or distributes stolen credentials, leaked databases, or breached data
  • Promotes or facilitates the sale of illegal drugs, weapons, or other controlled substances
  • Contains deceptive, misleading, or fraudulent material designed to deceive end users

3. Prohibited Activities

You may not use NoobHost services to:

Network Abuse

  • Launch, facilitate, or participate in DDoS attacks or any denial-of-service attacks
  • Operate DDoS "booter," "stresser," or IP stress-testing services
  • Conduct unauthorized port scanning, network probing, or vulnerability scanning of any system
  • Perform brute-force attacks, credential stuffing, or password cracking against any system
  • Engage in traffic amplification, reflection attacks, or DNS amplification
  • Operate open resolvers, open SMTP relays, or open proxies that can be used to facilitate abuse
  • Spoof source IP addresses or manipulate network headers
  • Intercept, monitor, or redirect traffic not intended for your services

Email and Communication Abuse

  • Send unsolicited bulk email (spam), including commercial and non-commercial spam
  • Send email with forged, misleading, or spoofed headers or sender addresses
  • Operate mailing lists without proper opt-in/opt-out mechanisms
  • Harvest email addresses or other personal information from the internet

System and Infrastructure Abuse

  • Mine cryptocurrency, including proof-of-work or proof-of-stake mining, without explicit written permission
  • Circumvent, bypass, or attempt to bypass resource limits, quotas, or rate limits
  • Resell, redistribute, or sublicense services without written authorization
  • Interfere with, degrade, or disrupt other customers' services or shared infrastructure
  • Attempt to gain unauthorized access to NoobHost systems, infrastructure, management panels, or other customer accounts
  • Exploit vulnerabilities in NoobHost software, APIs, or infrastructure (report them to security@noobhost.com instead)
  • Run TOR exit nodes, anonymous routing services, or encrypted tunnel services designed to circumvent law enforcement
  • Use services for any purpose that negatively impacts the stability, security, or performance of shared infrastructure

4. Resource Usage and Fair Use

  • All services must operate within the resource limits of your subscribed plan
  • Sustained high CPU, memory, disk I/O, or bandwidth usage that impacts shared infrastructure or other customers may be throttled, rate-limited, or suspended without prior notice
  • For non-emergency resource issues, we will attempt to notify you and offer upgrade options before taking action
  • Automated scripts, bots, or processes that generate excessive API requests will be rate-limited or blocked
  • Intentional resource abuse (e.g., fork bombs, infinite loops, disk-filling scripts) will result in immediate suspension
  • We reserve the right to define and enforce fair use limits at our sole discretion

5. Game Server Specific Rules

  • Game servers must run officially supported game software obtained through legitimate channels
  • Cheating tools, exploits, aimbots, game-crashing software, or griefing tools are strictly prohibited
  • Pirated game servers, cracked server software, or license key sharing is not allowed
  • DDoS "booter" or "stresser" services disguised as game servers are prohibited - zero tolerance
  • Game servers may not be used as general-purpose compute, file storage, or proxy services
  • You must comply with the game publisher's terms of service and EULA for any software running on our platform

6. Compliance Obligations

  • You must comply with all applicable laws and regulations, including but not limited to export control laws, sanctions, data protection regulations (GDPR, CCPA), and DMCA requirements
  • You must respond promptly to valid DMCA takedown notices and remove infringing content within the timeframe specified
  • You must not use our services to circumvent economic sanctions or export restrictions imposed by any applicable jurisdiction
  • You are responsible for obtaining any required licenses, permits, or authorizations for content or software hosted on our platform

7. Monitoring and Investigation

We reserve the right, but have no obligation, to monitor, investigate, and review any activity on our network and services for compliance with this AUP. This may include:

  • Automated monitoring of traffic patterns, resource usage, and network behavior
  • Manual investigation in response to abuse reports, legal requests, or suspicious activity
  • Logging of network traffic metadata, access logs, and system events for security purposes
  • Analyzing content when we have a reasonable belief that a violation has occurred

We will handle all data collected through monitoring in accordance with our Privacy Policy.

8. Enforcement

We reserve the right to take any action we deem necessary, at our sole discretion, to enforce this AUP and protect our infrastructure, customers, and reputation. Enforcement actions are determined by severity and may include:

  • Warning: First-time minor violations may receive a warning with a remediation deadline (typically 24–48 hours)
  • Content Removal: We may remove or disable access to violating content without prior notice
  • Throttling/Rate Limiting: Excessive resource usage may be throttled to protect shared infrastructure
  • Suspension: Moderate or repeated violations result in service suspension pending review
  • Immediate Termination: Severe violations result in immediate, permanent account termination without refund. These include, but are not limited to: illegal content, CSAM, DDoS attacks, active exploitation of our infrastructure, or any activity posing an imminent threat

Important Notes on Enforcement

  • We are under no obligation to provide advance notice before taking enforcement action for severe or imminent threats
  • Enforcement is applied at our sole discretion and is not subject to appeal for severe violations
  • For moderate violations, you may request a review by contacting abuse@noobhost.com within 7 days
  • Accounts terminated for AUP violations are not eligible for refunds of any kind
  • We may retain evidence of violations for legal purposes

9. Cooperation with Law Enforcement

We will cooperate with law enforcement agencies, regulatory authorities, and court orders as required by law or as we deem necessary in our sole discretion. This includes, but is not limited to:

  • Disclosing account information, logs, and content in response to valid legal process
  • Preserving data and evidence when required by law or upon receipt of a preservation request
  • Reporting illegal activity, including CSAM, to the appropriate authorities (NCMEC, FBI, local law enforcement)
  • Providing technical assistance to law enforcement investigations when legally compelled

10. Reporting Abuse

To report a violation of this policy, contact us at abuse@noobhost.com or use our abuse report form. Include as much detail as possible, including URLs, IP addresses, timestamps, screenshots, and any other evidence. We aim to acknowledge abuse reports within 24 hours and take initial action within 48 hours.

For security vulnerabilities in NoobHost infrastructure, please report to security@noobhost.com.

11. Changes to this Policy

We may update this AUP from time to time. Material changes will be communicated via email or notice on our website at least 14 days before taking effect. Your continued use of the Services after the effective date constitutes acceptance of the updated AUP. It is your responsibility to review this policy periodically.
